The Madrid System allows trademark owners to protect their marks in numerous countries with a single worldwide application. It is both convenient and affordable. Here’s how the process typically works:
Basic Trademark Registration: Before applying abroad, you must have a valid trademark registration or application in your home country, which will serve as the foundation for your international application.
File an International Application: Contact your home country’s trademark office to submit an international trademark application. This application will be based on your existing trademark registration or application in your native country.
Designate Countries: In the international application, designate the countries for which you seek trademark protection. These countries must be parties to the Madrid Protocol or Madrid Agreement.
International Bureau: The international application is transmitted to the World Intellectual Property Organization (WIPO) in Geneva, Switzerland, which serves as the Madrid System’s International Bureau.
Examination and Registration: WIPO reviews the international application to confirm that it meets all formal requirements. If accepted, WIPO will register the mark and make it available in the International Trademark Gazette.
Transmission to specified Countries: WIPO transfers the international registration to the specified countries’ trademark authorities for inspection and potential objection from third parties.
National Registration: Once accepted by the selected nations’ national trademark authorities, the mark is protected in all of those countries as if it had been filed directly there.
