Trademark assignment in India is the transfer of ownership of a registered trademark from one party (assignor) to another (assignee). Below is a summary of the trademark assignment process in India:

Agreement Preparation: The assignor and assignee must enter into a trademark assignment agreement that details the terms and conditions of the transfer, including the rights, duties, and consideration involved. The agreement should be executed on non-judicial stamp paper of adequate value in accordance with the Stamp Act.

Application for Assignment: Once both parties have finalized and signed the agreement, an application for trademark assignment must be filed with the Trademark Office. The application should be submitted in the prescribed form, together with the prescribed money.

Advertisement in Trademark Journal: Once the application is filed, the Trademark Office will review the assignment documents and, if satisfied, publish the assignment information in the Trademarks Journal.

Opposition Period: The publication in the Trademarks Journal triggers a three-month period during which any interested person with valid grounds can register an opposition to the assignment.

Assignment Certificate: If no opposition is submitted within the time frame specified or if any opposition is successfully resolved in favor of the assignment, the Trademark Office will issue a Certificate of Assignment to the assignee.

Trademark Records Update: Upon receipt of the Assignment Certificate, the trademark records are changed to reflect the new owner’s information, and the assignee takes legal ownership of the trademark.
