Design Registration
Design registration is a legal process that formally protects a product’s unique visual appearance or decorative elements, providing the owner exclusive rights to use, manufacture, import, and sell the design. It involves filing an application to the appropriate intellectual property office, along with visual representations or drawings of the design, and paying the applicable fees. Once registered, the design owner enjoys legal protection against illegal copying or growth of the registered design by others, protecting their investment in the original design while also encouraging innovation in the industrial and commercial sectors.
Step-By-Step Process for Design Registration :-
Preparation: Before beginning the registration procedure, make sure that your design fits the eligibility criteria for registration, such as being new and having unique characteristics. Create accurate visual representations or drawings of the design, as well as any supporting documentation required by the application.
Application Submission: Fill out the design registration application form given by the relevant intellectual property agency. Submit the application with the necessary documents, which usually includes visual representations or drawings of the design, a description of the design, and payment of the registration cost.
Examination Process: If an examination is required, the intellectual property office will analyze the design to see if it fits the registration standards, such as being new and having unique characteristics. This method may include comparing the design to existing registered designs to determine its uniqueness.
Publication: After the design has been accepted for registration, it is usually published in the official gazette or register of designs. Publication informs the public about the existence of the registered design and allows third parties to challenge the registration if they believe it violates their rights.
Registration Certificate: If the application is approved and there are no oppositions or objections, the intellectual property office will issue a registration certificate for the design. This certificate acts as proof of ownership and allows the owner exclusive rights to use the registered design for the stated time period, usually several years.
Details Required for Design Registration :-
- Name, Nationality and Address of the Applicant.
- Title of the Design.
- Whether the captioned design has been registered/applied in some other country. If yes then whether you intend to claim priority.
- Details of design in case it has been filed in priority country. If priority is being claimed then priority documents will be required.
- Top, Bottom, Left, Right, Perspective, Front and Back view of the Designs ( if possible send photographic images).
- Kindly note that the pictures/drawings which you will be sending must have space to insert the Name of the applicant, Application No.( at the top) , the Name of the Attorney and the Name of our Company at the Bottom.
Further, we will have to send you the Power of Attorney (Authorization letter). The Power of Attorney will be prepared on the basis of information you will provide.
Once you provide us the requisite details we will draft the Authorization letter, send it to you and intimate you of the further process accordingly.
